BJS, Prisoners in 2022: about 32% of sentenced state and federal prisoners were Black. Black Americans are about 14% of the U.S. population. The Sentencing Project’s U.S. imprisonment-rate ratio is about 4.8 to 1, Black to white. A gap is a disparity. The discipline Undisputed: the U.S. incarcerates a larger share of its people than almost any nation; Black Americans are imprisoned at several times the white rate. Contested: how much of that is differences in offending versus differences in who is policed, stopped, charged, sentenced. Honest researchers say both, in proportions people argue about.
Where the system is well documented: discretionary points such as drug enforcement, where usage is similar across groups and arrest is not. You can accept the disparity without settling the full causal story. Disparity is an observation. Discrimination is a causal claim. Good scholarship does not collapse them.

Minnesota DHS child-welfare reporting as publicly summarized for 2023 (DHS-5408PA-ENG): Black and Hispanic youth about twice as likely as white children to be in out-of-home care; American Indian / Native youth about sixteen times as likely. ICWA is a government-to-government path, not a diversity module. A sixteen-times gap in your own agency’s data is not “national politics.” It is a Minnesota human-services outcome. Cause still has to be argued. The number does not get to be ignored.
